Indiana House Passes Bill Requiring Cooperation With Federal Immigration Enforcement

(INDIANAPOLIS) - The Indiana House has approved legislation aimed at strengthening cooperation between local agencies and federal immigration authorities.

Senate Bill 76, referred to by supporters as the "Fairness Act," passed the House on a 60-28 vote Thursday. The amended measure now returns to the Indiana Senate for consideration before it can be sent to Gov. Mike Braun.

Supporters say the bill is intended to prevent so-called sanctuary policies and ensure compliance with federal immigration enforcement efforts. The legislation would require local law enforcement agencies to honor requests from U.S. Immigration and Customs Enforcement (ICE) to detain individuals and would prohibit public agencies -- including schools and colleges -- from restricting enforcement activities by federal, state or local authorities.

The bill also authorizes the Indiana Attorney General to pursue legal action against businesses that knowingly employ undocumented immigrants.

Republican lawmakers backing the measure said it reinforces the rule of law and creates a level playing field for employers. Attorney General Todd Rokita praised the House action, urging the Senate to quickly approve the bill so it can reach the governor's desk.

Democratic lawmakers and some community members voiced strong opposition, arguing the measure could divert local public safety resources, infringe on constitutional rights and strain relationships between immigrant communities and law enforcement.

Protesters gathered outside the House chamber during debate, calling on lawmakers to reject the proposal.

The bill's final fate now depends on whether the Senate agrees to the House changes before the legislative session concludes.
